CALIFORNIA LAW ON GROSS VEHICULAR MANSLAUGHTER WHILE INTOXICATED
You are guilty of committing vehicular manslaughter while under the influence
of alcohol or drugs if you were driving while intoxicated, causing you
to commit a grossly negligent act – such as driving off of the road
and into a crowd of people. Under the pertinent provisions of the California
Vehicle Code and California Penal Code, a person is considered to have
been driving under the influence of alcohol if their blood alcohol content
was 0.08% or higher.
The crime of vehicular manslaughter while intoxicated is considered a felony
that is punishable by incarceration in state prison for up to 10 years
in addition to hefty criminal penalties. Furthermore, your driver’s

- “While in violation of Section 23140, 23152, or 253153 of the Vehicle
Code” (prohibiting driving under the influence of drugs or alcohol); and
- “The killing was the proximate result of the commission of an unlawful
act, not amounting to a felony, and with gross negligence, or the proximate
result of the commission of a lawful act that might produce death, in
an unlawful manner, and with gross negligence.”
